NUIO Design Inc. Limited Product Warranty Policy and Limitation Of Liability

This limited product warranty applies to the original purchaser only. The NUIO Design Inc. (NUIO) product will be free from defects in materials and workmanship for one year from the earlier of (1) the date of purchase or (2) the date of delivery. Except where prohibited by applicable law, this warranty is nontransferable and is limited to the original purchaser and the country in which the product was purchased. The purchaser may also have other rights under local laws.  

The exclusive remedy for any breach of warranty will be, at NUIO’s option, either (1) to repair the product, or (2) to replace the product.  In either case, the product must be returned to NUIO with a copy of the original sales documentation. Shipping and handling charges will apply except where prohibited by applicable law.  If the warranty claim is found to be valid, NUIO may reimburse the purchaser for the shipping and handling charge.

If the product is replaced, it will be warranted for the remainder of the original warranty period or for 30 days from the return date, whichever is longer, or for any additional period of time that may be applicable in the jurisdiction where the purchaser is located.

This limited warranty does not apply if the defect, failure or other problem was caused in whole or in part by (1) accident, abuse, misuse, or any unauthorized repair, modification or disassembly; (2) improper operation, storage or maintenance, usage not in accordance with product instructions, or connection to improper power supply; (3) use of consumables, such as replacement batteries, not supplied or authorized by NUIO; (4) missing or lost parts that were originally supplied with the product; (5) use of the product with other non-NUIO parts and accessories; or (6) normal wear and tear.

This limited warranty does not apply to claimed loss or damage to any other non-NUIO electronic device, other product or any other personal property of any kind.

Exclusion of IMPLIED WARRANTIES

There are no warranties which EXPAND COVERAGE OR extend beyond the SPECIFIC TERMS OF THIS LIMITED WARRANTY. Any IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON ANY NUIO PRODUCT is hereby DISCLAIMED OR excluded. no person or entity is authorized to modify or extend the LIMITED warranty provided ON ANY NUIO PRODUCT. 

LIMITATION OF LIABILITY

NEITHER NUIO NOR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE OR DATA (WHETHER DIRECT OR INDIRECT), OR COST OF PROCURING SUBSTITUTE PRODUCTS, FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY APPLICABLE TO NUIO PRODUCTS OR OTHERWISE ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH THE PURCHASE, USE OR PERFORMANCE OF NUIO PRODUCTS, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, AND WHETHER OR NOT NUIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.  BY PURCHASING NUIO PRODUCT, PURCHASER AGREES THAT THESE LIMITATIONS WILL SURVIVE AND APPLY EVEN IF THE LIMITED WARRANTY IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT WILL NUIO’S LIABILITY TO ANY PURCHASER ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH ANY NUIO PRODUCT FROM ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY, EXCEED THE ACTUAL AMOUNT PAID TO NUIO BY ANY PURCHASER FOR THE PRODUCT THAT GIVES RISE TO ANY CLAIM.  Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply.
